1. Acceptance
By installing, activating, or using EVE — the desktop application — you accept these terms. If you don't accept them, don't install the app.
2. What EVE is (and isn't)
EVE is a desktop trading workstation built around a voice partner. She watches your charts, your positions, and your decisions, and intervenes in real time per your configured rules. She narrates the tape. She remembers your patterns. She refuses to let you quietly break your own discipline rules.
EVE does not place trades on your behalf without your explicit confirmation. Every order requires a click or a voice confirmation by you. EVE is a partner, not an autopilot.
EVE is not a broker. EVE does not custody your money. EVE does not hold securities. Your account, your orders, your fills, and your settlements live with your broker (Charles Schwab today; more to follow). EVE talks to your broker on your behalf using the access credential you provide.
EVE is not affiliated with, endorsed by, or sponsored by Charles Schwab. "Schwab" is referenced solely to identify the brokerage you connect your own account to. EVE is an independent product of 50/50 Entertainment.
3. License to use
We grant you a non-exclusive, non-transferable, revocable license to install and run EVE on machines you own or control, for your personal use, subject to your active subscription tier. You may not redistribute the app, reverse-engineer it, or rebrand it. White-label or enterprise licensing requires a separate agreement.
4. Your account & data
EVE stores your settings, watchlists, drawings, journal entries, and patterns in a profile.json file on your machine. We don't keep a copy. You own it. You can move it, back it up, or delete it at will.
Your broker key lives in your operating system's secure credential vault. We never see it. We never relay it. If you delete it, EVE forgets it.
Your voice interactions stay private to your session. We don't relay them through our servers. We don't store them. See the Privacy Policy.
5. Pricing & billing
Tiers and current prices are listed on the pricing section. Founder's Edition operators who reserve a slot before Jun 8, 2026 lock the launch rate forever — even after the public rate ratchets up. Pricing is in US dollars. Pro and Apex are billed monthly. Free is always free.
You can cancel any time. Refunds for partial months are issued on request, pro-rated to the day of cancellation.
6. Not investment advice
EVE is software. EVE is not a financial advisor, broker-dealer, investment adviser, fiduciary, or fortune teller. Nothing EVE says, displays, draws on a chart, or includes in a journal recall is investment advice. Setups, grades, patterns, and intervention messages are pattern-recognition output based on your configured rules and your own historical data — they are not predictions of future returns.
7. Limitation of liability
To the maximum extent permitted by law, EVE and its operators are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the app — including (but not limited to) trading losses, missed trades, software bugs, data feed outages, broker outages, voice transcription errors, holographic projection misreads, or any other cause.
If we are found liable for any reason, our total liability to you in any 12-month period is capped at the amount you paid us for the app during that same period. If you're on the Free tier, that's $0.
8. No warranty
EVE is provided "as is" and "as available." We don't warrant that the app will be uninterrupted, error-free, or that it will produce profitable trades. Trading involves substantial risk. See the Risk Disclosure.
9. Prohibited conduct
- Using EVE to manipulate markets, run pump-and-dump schemes, or violate securities laws
- Using EVE on behalf of someone else without their explicit authorization
- Reverse-engineering, decompiling, or disassembling the app to extract proprietary algorithms
- Selling, sublicensing, or redistributing the app or any of its assets
- Using the EVE brand, logo, or "Upstairs Trader" identity in your own product or marketing without written permission
- Bypassing tier limits or licensing checks
10. Termination
You may terminate your subscription any time by canceling in-app or by emailing support@tradewitheve.com. We may suspend or terminate your access if you violate these terms. On termination, your profile.json stays on your machine — it's yours.
11. Changes to these terms
If we change these terms materially, the "Last revised" date updates and we'll post a note in-app at next boot. Continued use after the change is acceptance of the new terms. If you don't accept them, stop using the app and cancel.
12. Governing law
These terms are governed by the laws of the United States. Disputes will be resolved through binding arbitration in the founder's home jurisdiction, with the exception of small-claims matters which may proceed in court.
